Um Sistema de Apoio à Dosimetria da Pena Utilizando Fuzzy Logic

Of the three successive phases that compose Dosimetry of the Condemnation, the first refers to the Judicial Circumstances and second the Aggravating and Extenuating Legal Circumstances, determined by the articles 59, 61, 62, 65 and 66 of the Brazilian penal code. The therefore of the crimes foreseen from the art. 121 to the art. 359 are defined by an interval, therefore it is necessary for the magistrate to apply the circumstances and to extract an exact value of the Condemnation. However, to apply them, the Code doesn't prescribe an amount or a " quantum " for each one of them. This situation generates an uncertainty factor. Like this, the magistrates involuntarily apply different terms for similar crimes. For treatment of uncertainties, the Diffuse Logic or Nebula (Fuzzy Logic) an excellent technique is considered, being used in different areas of interest. The application in Dosimetry of the Condemnation start by attributing a value of importance of the circumstances in a mathemat ical function, called "membership function. A group of control rules will treat condit ionally of the equivalence of the circumstances in that the total domain of variation of the values is divided attributed to the circumstances. The action of the rules with the respective membership degrees forms the process of Fuzzyfication. The method of the center of gravity is used in the process of Defuzzyfication, resulting an exact value that represents the " aggravation quantum or attenuation" of referring feather the first two phases of Dosimetry of the Condemnation.
